Steps in the Enforcement Process

  1. Inspection/Investigation
  2. Compliance action is determined on:
    1. Informal notice - Warning, Request for Amendment
    2. Legal Proceeding - Notice of Proposed Violation, Notice of Amendment, Hazardous Facilities Order
  3. Compliance Action is issued to operator
  4. Operator responds (usually within 30 days)

Compliance Action Type

Warning - Not a legal proceeding. Utilized when there is no previous enforcement history and poses a low risks to public safety and/or facility integrity

Notice of Probable Violation (NPV) - A legal proceeding. Utilized when there is a previous enforcement history or poses a moderate to severe risk to public safety or facility integrity.

Request for Amendment (RFA) - Not a legal proceeding. Utilized when an operator’s plans or procedures are insufficient to ensure compliant operation.

Notice of Amendment (NOA) - A legal proceeding. Utilized when an operator’s plans or procedures are inadequate to ensure compliant operation.

Hazardous Facilities Order (HFO) - A legal proceeding. Utilized when a facility may pose a severe and imminent risk to public safety. 

Compliance Status

Closed - Operator and PUC have determined that steps moving forward are acceptable to both parties.

Open - PUC issued to operator. Associated parties are working through compliance and response.

Pending Operator Response - Up to 30 days by rules for an operator to provide an initial response to the compliance action

Settlement in Process - Settlement negotiation is in process
 

How to Find Compliance Action Documents

This provides a link and instructions on how to find and review the compliance action documents that PSP has prepared. The regulatory definition of a compliance action can be found here. Please review the following instructional video for finding gas pipeline safety compliance documents in E-Filings.

1. Compliance actions issued to gas pipeline operators and utilities can be found on the at this link on PUC's E-Filings website.
2. Once in the E-Filings location, select, "Search" at the bottom of the menu on the left side of the page.
3. In the search form that loads, select, "Proceedings" from the "Search for" drop down menu.
4. Next, select "Gas Pipeline Safety" from the "Industry" drop down menu.
5. Click on the "Search" button within the grey box.

This search will provide a complete listing of all Proceedings associated with the Pipeline Safety Program. You may view all public documents within each individual proceeding.
