Transportation: Recent Legislative Updates
Effective June 28, 2021, HB21-1206 modified § 40-10.1-301 and 302 C.R.S., removing the requirement for Medicaid transportation providers to obtain a Medicaid Client Transport (MCT) permit. The Colorado Department of Health Care Policy & Financing (HCPF) is now responsible for the oversight of newly enrolling and revalidating Medicaid transportation providers. As of March 2, 2022, there is no longer a maximum age of motor vehicle requirement for passenger-carrying motor vehicles, according to PUC Decision Number: R21-0771, in Proceeding Number: 21R-0359TR. Please refer to amended Rules 6117 and 6305 for more information.
As of July 1, 2022, transportation carriers will be allowed to assess credit card surcharges , in addition to all other fees/charges approved by the Commission. This is based on statutory changes, especially to § 5-2-212, C.R.S, pursuant to Senate Bill 21-091. The PUC encourages stakeholders to review this legislation, and the updated statute(s), to view the extent of the changes and how they are correctly applied.
